NOTICE OF SHERIFF’S SALE
UNDER JUDGMENT OF
MORTGAGE FORECLOSURE
NOTICE IS HEREBY GIVEN that under and by virtue of the judgment that was entered in the above-captioned matter on July 7, 2025, a certified copy of which has been delivered to me, I, Ryan Shea, Sheriff of Freeborn County, Minnesota, will sell at public auction, to the highest bidder for cash, on Thursday, October 1, 2026, at 10:00 a.m., at the Office of the Freeborn County Sheriff, 411 Broadway Avenue South, Albert Lea, Minnesota 56007, the following real properties in Freeborn County, Minnesota:
• The premises and real estate legally described on Exhibit A that have a physical street address of 315 Johnson Street, Hartland, Minnesota 56042 and a parcel identification number of 28-021-0020 (“Real Property 1”) and
• The premises and real estate legally described on Exhibit B that have a physical street address of 498 East Main Street, Clarks Grove, Minnesota 56016 and parcel identification numbers of 18-035-0020 and 22-014-0142 (“Real Property 2”).
Real Property 1 and Real Property 2 are hereinafter collectively referred to as the “Real Properties.” The Real Properties are separate and distinct pieces of land that will be bid on and sold separately. The sale of the Real Properties will be made to partially satisfy the sum of $1,228,478.10, the total dollar amount, that as of June 30, 2026, the Court determined and adjudged was due and owing from DEFENDANTS A & S STORES LLC, MEHUL SHAH, AND NITESH AWASTHI to PLAINTIFF CITIZENS ALLIANCE BANK, plus the following: (1) continuing interest from June 30, 2026 at the per diem rate of $263.82 until entry of judgment and then interest at the statutory judgment rate until judgment is satisfied; (2) the costs and disbursements and attorney fees, including, but not limited to, the costs and disbursements and attorney fees related to the sale of the Real Properties, that PLAINTIFF CITIZENS ALLIANCE BANK has incurred or will incur in this matter; and (3) any protective advances that PLAINTIFF CITIZENS ALLIANCE BANK has made or may make on the Real Properties.
The sale shall be subject to redemption by the Mortgagor or personal representative(s) or assignee(s) of the Mortgagor within six (6) months from the date of the Court Order confirming the sale.
